Walter Mason focuses on wrongful death, civil rights, medical malpractice, products liability, and catastrophic injury cases. Mr. Mason has a deep passion to achieve justice for victims. His most potent memories of pride and accomplishment come from the victories he has shared with clients and seeing the subsequent transformations in their lives.
Mr. Mason graduated fourth in his class from the S.J. Quinney College of Law at the University of Utah, where he served as Note and Comment Editor for the Utah Law Review. During law school, he interned with Justice John A. Pearce of the Utah Supreme Court and was a quarterfinalist in a national moot court competition. His academic excellence earned him an invitation to the prestigious Order of the Coif and awards in Torts, Civil Procedure, Constitutional Law, Statutory Interpretation, and other subjects. Concurrently, he completed a Master of Business Administration, focusing on international business during a study program in Tokyo, Japan, and participated in a human rights consortium at the University of Oxford in England.
Before joining DKOW, Mr. Mason honed his litigation skills under the mentorship of Rocky Anderson, one of Utah’s most respected civil rights attorneys and former mayor of Salt Lake City. Together, at Anderson & Mason, they litigated civil rights cases in both state and federal courts. Their successes include obtaining justice for a woman who died due to lack of medical care while in the Salt Lake County Jail, and securing compensation for an innocent bystander shot by a police officer. They also tackled high-profile cases, such as challenging restrictive provisions in Utah’s medical cannabis law, winning a First Amendment case against the State of Utah, and fighting unconstitutional surveillance by the NSA. In addition, they frequently addressed the unconstitutionality of state laws limiting citizens’ ability to bring claims against law enforcement officers and advocated for survivors of child sexual abuse.
At DKOW, Mr. Mason leads the firm’s national opioid litigation, representing 18 of Utah’s 29 counties. His work has contributed to securing tens of millions of dollars in settlements. He also has an impressive track record of resolving catastrophic injury and wrongful death cases, including those involving medical malpractice, product liability, police misconduct, inmate healthcare, and trucking accidents. Mr. Mason is highly skilled in managing all phases of litigation, from initial case assessment through trial and appeal.
Mr. Mason has briefed and argued matters before the Tenth Circuit Court of Appeals, the Utah Supreme Court, and the Utah Court of Appeals. Those cases include:
Feasel v. Tracker Marine LLC et al, 2021 UT 47, in which Mr. Mason helped establish the legal standards that apply in Utah to determine whether product warnings are adequate.
Smith v. Volkswagen SouthTowne, 2024 UT App 33, in which Mr. Mason protected the right of a plaintiff to obtain interest on a judgment (in this case, that interest was over $400,000).
Mitchell v. Roberts, No. 21-4055 (10th Cir. 2022), in which Mr. Mason advocated for the rights of victims of child sexual abuse to bring claims against the perpetrators.
